Regulations of the FORSAIL & SKI CLUB Sports Equipment Rental

The owner of a sports equipment rental company operating under the FORSAIL & SKI CLUB brand at Drawska Street 22, 02-202 Warsaw, is the company FORSAIL Sp.j. with its registered office in Warsaw, Ciołka Street 13/111, with the TAX number 527-24-52-434 (hereinafter referred to as the Rental Shop).

The person renting sports equipment (Client) may be an adult person who concludes an agreement with the Rental Company on the terms specified in the agreement, an integral part of which are these Regulations (hereinafter referred to as the Regulations) and the rental price list (hereinafter referred to as the Price List). The price list and these Regulations are available on the rental website www.forsail-skiclub.pl and at the rental office.

In order to conclude a rental agreement, the Client of sports equipment is obliged to:

  • show the Rental Shop two valid documents with a current photo,
  • sign the equipment rental agreement,
  • make the entire payment for the planned rental period in advance,
  • pay the deposit set by the Rental Shop, indicated in the price list for renting a given type of equipment.

The issue and return of the equipment takes place at the Rental Shop. The Client is obliged to return the rented equipment within the period specified in the contract in a condition not worse than at the time of its rental.

The Rental Shop provides the Client with complete equipment, technically efficient, in accordance with applicable safety regulations. The Rental Shop is not responsible for defects hidden in parts, materials and accessories (accessories). The rented equipment may have traces of use that do not affect its technical efficiency.

At the time of receipt of the equipment, the Client is obliged to make sure that it is complete, in good technical condition allowing for proper and safe use, and report any damage immediately to the employee of the Rental Shop.

When concluding the rental agreement, the Client is obliged to provide his weight in order to set the force of releasing the ski boot from the ski bindings and true information about his skills that may affect the proper selection and fitting of the rented equipment. The Rental Shop will make every effort to match the equipment and its setting to the Client, however, it is not responsible for any events resulting from the use of the equipment, both towards the Client and third parties.

The Rental Shop reserves the right to refuse to rent or hand over the equipment to a minor or a person under the influence of alcohol or other intoxicants.

The Client is obliged to use the rented equipment with caution, care and in accordance with its intended purpose, i.e. the use of the equipment is possible only on prepared, snow-covered routes. It is forbidden to put on and move around in the rented equipment in parking lots and other places not intended for skiing and snowboarding.

The Client may not make any repairs to the rented equipment or give it to third parties for use. Using the equipment or lending it to a third party is at the Clients’s own risk.

The Client is financially responsible for damage, destruction or loss of the rented equipment up to the amount corresponding to the value of the rented equipment indicated in the contract.

The Client is obliged to immediately report to the Rental Shop the loss, destruction and any damage to the rented equipment that occurred during its use.

In the event of damage to the rented equipment, the Rental Shop will charge the Client with the cost of its repair, and in the event of damage or loss, with the costs of purchasing new equipment corresponding to the value and quality of the rented equipment. The Rental Shop reserves the right to deduct these costs from the deposit paid by the Client, and if its value does not cover these costs, to claim the difference from the borrower.

In the event of an earlier return of the equipment than provided for in the contract, the Rental Shop does not refund the money for the unused time.

The Client may extend the period of equipment rental, provided that the Rental Shop is informed at the latest on the end of the equipment rental period and its approval is obtained. If accepted by the Rental Shop, the extension of the equipment rental period results in an additional fee for each day of extending the rental period, determined on the basis of the price list in force at the time of rental.

In the event of failure to return the rented equipment within the period specified in the contract and in the absence of acceptance of the extension of the equipment rental period by the Rental Shop, the Rental Shop will charge a contractual penalty in the amount of three times the rental price of the equipment for each day of extension. Notwithstanding the above right, a case may be reported to law enforcement authorities as part of reporting a suspected misappropriation offence.

The Rental Shop instructs the renter that skiing and snowboarding are extreme sports that require fitness, physical condition and appropriate skills, associated with the risk of suffering bodily injuries of the renter or a third party. Children and teenagers up to the age of 16 are obliged to ride and adults are recommended to wear a protective helmet. Beginners are recommended to ride with an instructor.

The personal data of the Client will be processed only for the purpose of implementing this contract.

The Client has the right to access their data and to correct them if necessary.

Providing personal data is voluntary, however, it is necessary to rent equipment. The Rental Shop declares that it processes personal data in accordance with the provisions of these Regulations and the relevant provisions on the protection of personal data (RODO). When returning the equipment, personal data will be automatically deleted, unless the Client decides otherwise.

In case of doubts regarding the interpretation of these Regulations, the deciding party is the Rental Shop.

These Regulations come into force on the day of its publication and may be changed by the Rental Shop at any time. Any changes will not apply to contracts concluded on the basis of this version of the Regulations.
