The combination of travel services offered to you constitutes a package within the meaning of Directive (EU) 2015/2302.

Accordingly, you will enjoy all EU rights applicable to package travel. Forsail M. Fornal, P. Zagrobelna Sp.J. will bear full responsibility for the proper implementation of the entire tourist event.

In addition, as required by law, Forsail M. Fornal, P. Zagrobelna Sp.J. has security to ensure the return of payments to you and, if transport is part of the tourist event, to ensure your return to the country in the event that Forsail M. Fornal, P. Zagrobelna Sp.J. has become insolvent.

Key rights under Directive (EU) 2015/2302

Before concluding a package travel contract, travelers will receive all the necessary information about the package.

At least one entrepreneur is always responsible for the proper performance of all travel services covered by the contract.

Travelers are given an emergency telephone number or contact point details to contact the tour operator or travel agent.

Travelers may transfer the package to another person with reasonable notice, subject to any additional costs.

The price of the package may only be increased if certain costs (for example fuel costs) increase and this is expressly provided for in the contract; in no case may the price increase take place later than 20 days before the start of the package. If the price increase exceeds 8% of the package price, the traveler may terminate the contract. If the tour operator reserves the right to increase the price, the traveler has the right to reduce the price if the relevant costs have decreased.

Travelers may terminate the contract without paying any termination fee and receive a full refund of any payments made if one of the essential elements of the package, other than the price, changes significantly. If the trader responsible for the package cancels it before the start of the package, travelers shall be entitled to a refund and, where appropriate, to compensation.

–  In exceptional circumstances – for example, if there are serious security issues at the travel destination that may affect the package – travelers may, before the start of the package, terminate the contract without incurring any termination fee.

In addition, travelers may terminate the contract at any time prior to the start of the package for an appropriate and justifiable fee.

If, after the start of the package, significant elements of the package cannot be provided as agreed, suitable alternative services will have to be proposed at no additional cost. Where services are not provided in accordance with the contract and this significantly affects the performance of the package and the tour operator fails to remedy the problem, travelers may terminate the contract without a termination fee.

Travelers are also entitled to a price reduction or compensation for damage in the event of non-performance or improper performance of travel services.

The tour operator must provide assistance to a traveler who finds himself in difficulty.

In the event that the tour operator becomes insolvent, the payments will be returned. If the tour operator becomes insolvent after the start of the package and if the package includes transport, the repatriation of travelers is ensured.
